關于進一步規范地方政府舉債融資行為的通知

各省、自治(zhi)區(qu)、直轄市(shi)、計劃單列市(shi)財政廳(局(ju))、發展(zhan)改革委、司法廳(局(ju)),中(zhong)國(guo)人民銀(yin)行上(shang)海總部、各分行、營(ying)業管理部、省會(hui)(首府)城(cheng)市(shi)中(zhong)心支行、副省級城(cheng)市(shi)中(zhong)心支行,各銀(yin)監局(ju)、證(zheng)監局(ju):

  2014年(nian)修(xiu)訂的預算法(fa)和《國(guo)(guo)務院關于加強地(di)方政(zheng)府(fu)性(xing)(xing)債務管理的意見》(國(guo)(guo)發〔2014〕43號)實施以來,地(di)方各級政(zheng)府(fu)加快(kuai)建立規(gui)范(fan)的舉(ju)債融(rong)(rong)資機(ji)制,積極發揮政(zheng)府(fu)規(gui)范(fan)舉(ju)債對經濟(ji)社會(hui)發展(zhan)的支持作用,防范(fan)化解財政(zheng)金融(rong)(rong)風(feng)(feng)險,取得了階段性(xing)(xing)成效。但(dan)個別地(di)區違(wei)法(fa)違(wei)規(gui)舉(ju)債擔保時有發生,局部風(feng)(feng)險不容忽視。為貫徹落實黨(dang)中(zhong)央、國(guo)(guo)務院決策(ce)部署,牢牢守住不發生區域性(xing)(xing)系統性(xing)(xing)風(feng)(feng)險的底線(xian),現就進一步規(gui)范(fan)地(di)方政(zheng)府(fu)舉(ju)債融(rong)(rong)資行為有關事(shi)項通知如下(xia):

  一、全面組織開展地方政府融資(zi)擔保清(qing)理整改工作

  各(ge)省級(ji)(ji)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)要(yao)認真落實國(guo)務院(yuan)辦公(gong)廳印發(fa)的(de)《地(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)性債(zhai)務風險應急(ji)處(chu)置預案》(國(guo)辦函〔2016〕88號)要(yao)求,抓緊設立(li)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)性債(zhai)務管理領導(dao)小組(zu)(zu)(zu),指(zhi)導(dao)督促本級(ji)(ji)各(ge)部(bu)門(men)和市(shi)縣政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)進一步完(wan)善風險防范(fan)機(ji)制,結(jie)合(he)2016年開展的(de)融資(zi)平臺公(gong)司債(zhai)務等(deng)(deng)統計情況,盡快組(zu)(zu)(zu)織(zhi)一次(ci)地(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)及其部(bu)門(men)融資(zi)擔(dan)保行為摸(mo)底排查,督促相關(guan)(guan)(guan)部(bu)門(men)、市(shi)縣政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)加強與社(she)會資(zi)本方(fang)(fang)的(de)平等(deng)(deng)協商,依法完(wan)善合(he)同條款,分類妥善處(chu)置,全面(mian)改(gai)正(zheng)(zheng)地(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)不規范(fan)的(de)融資(zi)擔(dan)保行為。上述(shu)工作應當于2017年7月31日(ri)前(qian)清理整改(gai)到位,對逾(yu)期不改(gai)正(zheng)(zheng)或改(gai)正(zheng)(zheng)不到位的(de)相關(guan)(guan)(guan)部(bu)門(men)、市(shi)縣政(zheng)(zheng)(zheng)(zheng)府(fu)(fu),省級(ji)(ji)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)性債(zhai)務管理領導(dao)小組(zu)(zu)(zu)應當提請省級(ji)(ji)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)依法依規追(zhui)究相關(guan)(guan)(guan)責任(ren)(ren)人的(de)責任(ren)(ren)。財政(zheng)(zheng)(zheng)(zheng)部(bu)駐各(ge)地(di)(di)財政(zheng)(zheng)(zheng)(zheng)監察專員辦事處(chu)要(yao)密切跟蹤地(di)(di)方(fang)(fang)工作進展,發(fa)現問(wen)題(ti)及時報告。

   二(er)、切實加強(qiang)融資(zi)平臺公司融資(zi)管(guan)理

  加快政(zheng)(zheng)府(fu)職(zhi)能(neng)轉變,處(chu)理好政(zheng)(zheng)府(fu)和(he)市(shi)場(chang)(chang)的關(guan)系,進(jin)一步規范(fan)融(rong)(rong)(rong)(rong)(rong)資(zi)平(ping)臺公(gong)(gong)(gong)司融(rong)(rong)(rong)(rong)(rong)資(zi)行為管理,推動融(rong)(rong)(rong)(rong)(rong)資(zi)平(ping)臺公(gong)(gong)(gong)司盡快轉型為市(shi)場(chang)(chang)化(hua)(hua)運(yun)營(ying)的國(guo)有企業(ye)(ye)、依(yi)法(fa)(fa)(fa)合(he)規開展市(shi)場(chang)(chang)化(hua)(hua)融(rong)(rong)(rong)(rong)(rong)資(zi),地(di)方(fang)政(zheng)(zheng)府(fu)及其所屬(shu)部(bu)門不得干(gan)預(yu)融(rong)(rong)(rong)(rong)(rong)資(zi)平(ping)臺公(gong)(gong)(gong)司日常運(yun)營(ying)和(he)市(shi)場(chang)(chang)化(hua)(hua)融(rong)(rong)(rong)(rong)(rong)資(zi)。地(di)方(fang)政(zheng)(zheng)府(fu)不得將公(gong)(gong)(gong)益性資(zi)產、儲備(bei)土地(di)注入融(rong)(rong)(rong)(rong)(rong)資(zi)平(ping)臺公(gong)(gong)(gong)司,不得承諾(nuo)(nuo)將儲備(bei)土地(di)預(yu)期出讓收入作為融(rong)(rong)(rong)(rong)(rong)資(zi)平(ping)臺公(gong)(gong)(gong)司償債(zhai)(zhai)資(zi)金(jin)(jin)(jin)來源,不得利用政(zheng)(zheng)府(fu)性資(zi)源干(gan)預(yu)金(jin)(jin)(jin)融(rong)(rong)(rong)(rong)(rong)機(ji)(ji)構正常經營(ying)行為。金(jin)(jin)(jin)融(rong)(rong)(rong)(rong)(rong)機(ji)(ji)構應當(dang)依(yi)法(fa)(fa)(fa)合(he)規支持融(rong)(rong)(rong)(rong)(rong)資(zi)平(ping)臺公(gong)(gong)(gong)司市(shi)場(chang)(chang)化(hua)(hua)融(rong)(rong)(rong)(rong)(rong)資(zi),服務(wu)(wu)實體經濟發(fa)(fa)展。進(jin)一步健全信息披露機(ji)(ji)制,融(rong)(rong)(rong)(rong)(rong)資(zi)平(ping)臺公(gong)(gong)(gong)司在境內外舉(ju)(ju)債(zhai)(zhai)融(rong)(rong)(rong)(rong)(rong)資(zi)時,應當(dang)向(xiang)債(zhai)(zhai)權人主(zhu)動書(shu)面聲明不承擔政(zheng)(zheng)府(fu)融(rong)(rong)(rong)(rong)(rong)資(zi)職(zhi)能(neng),并明確自2015年1月1日起其新增債(zhai)(zhai)務(wu)(wu)依(yi)法(fa)(fa)(fa)不屬(shu)于(yu)地(di)方(fang)政(zheng)(zheng)府(fu)債(zhai)(zhai)務(wu)(wu)。金(jin)(jin)(jin)融(rong)(rong)(rong)(rong)(rong)機(ji)(ji)構應當(dang)嚴格(ge)規范(fan)融(rong)(rong)(rong)(rong)(rong)資(zi)管理,切實加強風(feng)險(xian)(xian)識別(bie)和(he)防范(fan),落實企業(ye)(ye)舉(ju)(ju)債(zhai)(zhai)準入條件,按商業(ye)(ye)化(hua)(hua)原(yuan)則履行相關(guan)程序,審(shen)慎評估(gu)舉(ju)(ju)債(zhai)(zhai)人財(cai)務(wu)(wu)能(neng)力和(he)還款(kuan)來源。金(jin)(jin)(jin)融(rong)(rong)(rong)(rong)(rong)機(ji)(ji)構為融(rong)(rong)(rong)(rong)(rong)資(zi)平(ping)臺公(gong)(gong)(gong)司等企業(ye)(ye)提供融(rong)(rong)(rong)(rong)(rong)資(zi)時,不得要(yao)求或接(jie)受地(di)方(fang)政(zheng)(zheng)府(fu)及其所屬(shu)部(bu)門以擔保(bao)(bao)函、承諾(nuo)(nuo)函、安慰函等任何形式提供擔保(bao)(bao)。對(dui)地(di)方(fang)政(zheng)(zheng)府(fu)違法(fa)(fa)(fa)違規舉(ju)(ju)債(zhai)(zhai)擔保(bao)(bao)形成的債(zhai)(zhai)務(wu)(wu),按照(zhao)《國(guo)務(wu)(wu)院辦(ban)公(gong)(gong)(gong)廳(ting)關(guan)于(yu)印發(fa)(fa)地(di)方(fang)政(zheng)(zheng)府(fu)性債(zhai)(zhai)務(wu)(wu)風(feng)險(xian)(xian)應急處(chu)置(zhi)預(yu)案(an)的通知》(國(guo)辦(ban)函〔2016〕88號(hao))、《財(cai)政(zheng)(zheng)部(bu)關(guan)于(yu)印發(fa)(fa)〈地(di)方(fang)政(zheng)(zheng)府(fu)性債(zhai)(zhai)務(wu)(wu)風(feng)險(xian)(xian)分(fen)類處(chu)置(zhi)指南〉的通知》(財(cai)預(yu)〔2016〕152號(hao))依(yi)法(fa)(fa)(fa)妥善處(chu)理。

  三(san)、規范政府與社(she)會資本方的合作行為

  地(di)方(fang)(fang)(fang)(fang)政(zheng)府應當規范政(zheng)府和(he)社(she)(she)(she)會(hui)資(zi)本(ben)(ben)合作(zuo)(PPP)。允許地(di)方(fang)(fang)(fang)(fang)政(zheng)府以(yi)單獨出(chu)資(zi)或與(yu)社(she)(she)(she)會(hui)資(zi)本(ben)(ben)共同出(chu)資(zi)方(fang)(fang)(fang)(fang)式設立(li)各(ge)(ge)類(lei)(lei)投(tou)(tou)資(zi)基金(jin),依法實(shi)行規范的(de)(de)(de)(de)市(shi)場化運作(zuo),按照利益(yi)共享(xiang)、風(feng)險共擔的(de)(de)(de)(de)原則(ze),引導社(she)(she)(she)會(hui)資(zi)本(ben)(ben)投(tou)(tou)資(zi)經濟社(she)(she)(she)會(hui)發展的(de)(de)(de)(de)重點領域和(he)薄弱環節,政(zheng)府可適(shi)當讓利。地(di)方(fang)(fang)(fang)(fang)政(zheng)府不得(de)(de)以(yi)借貸資(zi)金(jin)出(chu)資(zi)設立(li)各(ge)(ge)類(lei)(lei)投(tou)(tou)資(zi)基金(jin),嚴禁地(di)方(fang)(fang)(fang)(fang)政(zheng)府利用PPP、政(zheng)府出(chu)資(zi)的(de)(de)(de)(de)各(ge)(ge)類(lei)(lei)投(tou)(tou)資(zi)基金(jin)等方(fang)(fang)(fang)(fang)式違(wei)(wei)法違(wei)(wei)規變相舉債(zhai),除(chu)國(guo)務院(yuan)另有規定外(wai),地(di)方(fang)(fang)(fang)(fang)政(zheng)府及其所屬部門參(can)與(yu)PPP項(xiang)目、設立(li)政(zheng)府出(chu)資(zi)的(de)(de)(de)(de)各(ge)(ge)類(lei)(lei)投(tou)(tou)資(zi)基金(jin)時,不得(de)(de)以(yi)任(ren)何(he)方(fang)(fang)(fang)(fang)式承(cheng)(cheng)諾回購社(she)(she)(she)會(hui)資(zi)本(ben)(ben)方(fang)(fang)(fang)(fang)的(de)(de)(de)(de)投(tou)(tou)資(zi)本(ben)(ben)金(jin),不得(de)(de)以(yi)任(ren)何(he)方(fang)(fang)(fang)(fang)式承(cheng)(cheng)擔社(she)(she)(she)會(hui)資(zi)本(ben)(ben)方(fang)(fang)(fang)(fang)的(de)(de)(de)(de)投(tou)(tou)資(zi)本(ben)(ben)金(jin)損失,不得(de)(de)以(yi)任(ren)何(he)方(fang)(fang)(fang)(fang)式向社(she)(she)(she)會(hui)資(zi)本(ben)(ben)方(fang)(fang)(fang)(fang)承(cheng)(cheng)諾最低收益(yi),不得(de)(de)對有限合伙制(zhi)基金(jin)等任(ren)何(he)股(gu)權投(tou)(tou)資(zi)方(fang)(fang)(fang)(fang)式額外(wai)附加條款變相舉債(zhai)。

  四、進一(yi)步健全規范的地(di)方政府舉債融資機制

  全(quan)面貫徹落實依(yi)(yi)法治國戰略,嚴格執(zhi)行預(yu)算法和(he)國發〔2014〕43號文件規(gui)定(ding),健全(quan)規(gui)范的地(di)方(fang)(fang)(fang)(fang)(fang)政(zheng)府(fu)(fu)(fu)舉債(zhai)(zhai)融資機制(zhi)(zhi),地(di)方(fang)(fang)(fang)(fang)(fang)政(zheng)府(fu)(fu)(fu)舉債(zhai)(zhai)一律采(cai)取(qu)在國務(wu)(wu)院批準的限額內(nei)發行地(di)方(fang)(fang)(fang)(fang)(fang)政(zheng)府(fu)(fu)(fu)債(zhai)(zhai)券(quan)方(fang)(fang)(fang)(fang)(fang)式(shi),除(chu)此以(yi)外(wai)地(di)方(fang)(fang)(fang)(fang)(fang)政(zheng)府(fu)(fu)(fu)及(ji)其所屬(shu)部門(men)不(bu)得(de)以(yi)任(ren)(ren)(ren)何方(fang)(fang)(fang)(fang)(fang)式(shi)舉借債(zhai)(zhai)務(wu)(wu)。地(di)方(fang)(fang)(fang)(fang)(fang)政(zheng)府(fu)(fu)(fu)及(ji)其所屬(shu)部門(men)不(bu)得(de)以(yi)文件、會議紀要、領導批示等任(ren)(ren)(ren)何形式(shi),要求或(huo)決定(ding)企業為(wei)政(zheng)府(fu)(fu)(fu)舉債(zhai)(zhai)或(huo)變相(xiang)為(wei)政(zheng)府(fu)(fu)(fu)舉債(zhai)(zhai)。允許地(di)方(fang)(fang)(fang)(fang)(fang)政(zheng)府(fu)(fu)(fu)結合財力可能(neng)設立或(huo)參股擔(dan)(dan)保(bao)(bao)(bao)公(gong)司(si)(si)(含各類融資擔(dan)(dan)保(bao)(bao)(bao)基金公(gong)司(si)(si)),構(gou)建市場化運(yun)作(zuo)的融資擔(dan)(dan)保(bao)(bao)(bao)體(ti)系,鼓勵政(zheng)府(fu)(fu)(fu)出資的擔(dan)(dan)保(bao)(bao)(bao)公(gong)司(si)(si)依(yi)(yi)法依(yi)(yi)規(gui)提(ti)供融資擔(dan)(dan)保(bao)(bao)(bao)服務(wu)(wu),地(di)方(fang)(fang)(fang)(fang)(fang)政(zheng)府(fu)(fu)(fu)依(yi)(yi)法在出資范圍內(nei)對擔(dan)(dan)保(bao)(bao)(bao)公(gong)司(si)(si)承擔(dan)(dan)責(ze)任(ren)(ren)(ren)。除(chu)外(wai)國政(zheng)府(fu)(fu)(fu)和(he)國際(ji)經濟(ji)組織貸款(kuan)轉貸外(wai),地(di)方(fang)(fang)(fang)(fang)(fang)政(zheng)府(fu)(fu)(fu)及(ji)其所屬(shu)部門(men)不(bu)得(de)為(wei)任(ren)(ren)(ren)何單位(wei)和(he)個人的債(zhai)(zhai)務(wu)(wu)以(yi)任(ren)(ren)(ren)何方(fang)(fang)(fang)(fang)(fang)式(shi)提(ti)供擔(dan)(dan)保(bao)(bao)(bao),不(bu)得(de)承諾為(wei)其他(ta)任(ren)(ren)(ren)何單位(wei)和(he)個人的融資承擔(dan)(dan)償債(zhai)(zhai)責(ze)任(ren)(ren)(ren)。地(di)方(fang)(fang)(fang)(fang)(fang)政(zheng)府(fu)(fu)(fu)應當(dang)科學制(zhi)(zhi)定(ding)債(zhai)(zhai)券(quan)發行計(ji)劃,根據(ju)實際(ji)需求合理(li)控制(zhi)(zhi)節(jie)奏和(he)規(gui)模(mo),提(ti)高債(zhai)(zhai)券(quan)透明度和(he)資金使用效益,建立信(xin)息共(gong)享機制(zhi)(zhi)。

  五(wu)、建立跨部(bu)門聯合監測(ce)和防(fang)控機(ji)制

  完善統計監測機制,由財政部門會同發展改革、人民銀行、銀監、證監等部門建設大數據監測平臺,統計監測政府中長期支出事項以及融資平臺公司舉借或發行的銀行貸款、資產管理產品、企業債券、公司債券、非金融企業債務融資工具等情況,加強部門信息共享和數據校驗,定期通報監測結果。開展跨部門聯合監管,建立財政、發展改革、司法行政機關、人民銀行、銀監、證監等部門以及注冊會計師協會、資產評估協會、律師協會等行業自律組織參加的監管機制,對地方政府及其所屬部門、融資平臺公司、金融機構、中介機構、法律服務機構等的違法違規行為加強跨部門聯合懲戒,形成監管合力。對地方政府及其所屬部門違法違規舉債或擔保的,依法依規追究負有直接責任的主管人員和其他直接責任人員的責任;對融資平臺公司從事或參與違法違規融資活動的,依法依規追究企業及其相關負責人責任;對金融機構違法違規向地方政府提供融資、要求或接受地方政府提供擔保承諾的,依法依規追究金融機構及其相關負責人和授信審批人員責任;對中介機構、法律服務機構違法違規為融資平臺公司出具審計報告、資產評估報告、信用評級報告、法律意見書等的,依法依規追究中介機構、法律服務機構及相關從業人員的責任。
  
六、大力推進信息公開

  各地區要充分認識規范地方政府舉債融資行為的重要性,把防范風險放在更加重要的位置,省級政府性債務管理領導小組要切實擔負起地方政府債務管理責任,進一步健全制度和機制,自覺維護總體國家安全,牢牢守住不發生區域性系統性風險的底線。各省(自治區、直轄市、計劃單列市)政府性債務管理領導小組辦公室應當匯總本地區舉債融資行為清理整改工作情況,報省級政府同意后,于2017年8月31日前反饋財政部,抄送發展改革委、人民銀行、銀監會、證監會。
